the Supreme Court is taking up the Moore v. Harper case ahead of 2024 should scare the hell out of all of us. This Court could gut our Presidential elections the same way they just gutted Roe. Here’s a thread on why it’s so dangerous and what we can do about it. 1)
See thread here:
The Supreme Court Is Not Supposed to Have This Much Power
And Congress should claw it back.
Article 3 of the Constitution gives the Supreme Court “original jurisdiction” in all cases affecting “Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party.” That part is obviously in effect, although most cases involving states occur in the lower federal courts established by Congress. The Constitution then states that in all other cases, “the Supreme Court shall have appellate jurisdiction.” This, too, is in full effect.
But then the Constitution tells us that the court’s appellate jurisdiction is subject to “such Exceptions” and “under such Regulations” as “the Congress shall make.”
The rot runs deeper
What the actions of an obscure Wisconsin political appointee tell us about GOP democratic backsliding
Sure it is a lot to read, but hey, is your future not worth it?
UPDATE: Why Bother?
As we are watching, the Supreme Court — in collaboration with state legislatures through activists like Ginny Thomas — are setting that election up right now in front of us in real time.
We damn well better be planning for this, because it’s likely coming our way in just a bit more than two short years.
This may be a blog, but it should set a fire under every Dems bottom... and has lots of URLs as well.
